THE CAMPBOARD TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern access to and use of The CampBoard, a campground guest-app, QR-code, information, announcement, event, map, guest alert, and analytics platform. The CampBoard is provided by The Computer Specialists, LLC, a Massachusetts limited liability company ("Company," "we," "us," or "our").
By creating an account, accepting a private invite, starting a trial, using Basic, using Premium, accessing the owner dashboard, uploading content, publishing a guest app, or otherwise using The CampBoard, you agree to these Terms. You also represent that you are authorized to bind the campground, business, organization, or other entity on whose behalf you are using The CampBoard ("Customer," "you," or "your").
1. Service Description
The CampBoard provides tools for campground owners and authorized staff to publish a mobile-friendly guest information page, QR code, announcements, events, campground information, maps, email-alert signup forms, and related dashboard features. Features may vary by plan, account status, rollout stage, private invite, trial status, or administrative setting.
The CampBoard is an informational software service. It is not an emergency communications system, public safety system, legal compliance system, reservation system, payment processor, life-safety system, evacuation system, dispatch system, or replacement for direct campground operations.
2. Customer Responsibility for Campground Operations
You are solely responsible for your campground, guests, staff, facilities, rules, policies, safety procedures, emergency procedures, legal compliance, accessibility obligations, pricing, reservations, check-in procedures, quiet hours, Wi-Fi terms, maps, directions, announcements, events, and all other campground operations.
You agree that guests must continue to rely on posted campground instructions, campground staff, emergency services, official notices, law enforcement, fire, EMS, weather authorities, and other appropriate channels for urgent, emergency, safety, legal, or operational matters.
You must not use The CampBoard as the sole or primary method for communicating emergency alerts, evacuation notices, severe weather warnings, medical instructions, fire notices, criminal activity warnings, or any information where delayed, inaccurate, unavailable, or missed delivery could cause injury, death, property damage, legal harm, financial loss, or other damage.
3. Customer Content
You are solely responsible for all content, information, files, maps, images, emails, announcements, events, rules, contact information, Wi-Fi information, amenities, emergency contacts, and other material that you or your users enter, upload, publish, display, send, or make available through The CampBoard ("Customer Content").
You represent and warrant that you have all rights and permissions necessary to provide and publish Customer Content through The CampBoard, and that Customer Content will be accurate, lawful, non-misleading, and appropriate for guests.
We do not verify Customer Content for accuracy, completeness, legality, accessibility, safety, suitability, or compliance. We may remove, restrict, suspend, or disable Customer Content or accounts if we believe content or use may violate these Terms, law, third-party rights, platform integrity, or the safety or reputation of The CampBoard or The Computer Specialists, LLC.
4. Acceptable Use
You agree not to use The CampBoard to:
- violate any federal, state, local, or international law or regulation;
- publish false, misleading, deceptive, defamatory, harassing, threatening, obscene, discriminatory, or unlawful content;
- infringe any intellectual property, privacy, publicity, contractual, or other rights;
- upload malware, harmful code, corrupted files, or materials designed to disrupt services;
- attempt unauthorized access to accounts, systems, networks, data, or administrative features;
- interfere with or degrade the security, availability, or performance of The CampBoard;
- send spam or unlawful email;
- collect or publish sensitive personal information unless you have all legally required rights, notices, and consents;
- imply that The CampBoard, The Computer Specialists, LLC, or any related party endorses your campground or content unless we have agreed in writing;
- use the service for emergency-only, life-safety, dispatch, or critical infrastructure purposes.
5. Plans, Trials, Private Invites, Billing, Pause, and Cancellation
The CampBoard may offer Basic, Premium, Seasonal Pause, free trials, comped accounts, private invites, beta accounts, promotional accounts, and other account types. Features, limits, prices, and availability may change over time. The price, billing interval, and plan details displayed at checkout or in the billing portal at the time of a transaction are part of these Terms.
Private invites and comped accounts may be modified, suspended, revoked, limited, or discontinued at our discretion, especially during beta, early-access, testing, or promotional periods.
5.1 Recurring Subscriptions and Cancellation
Basic and Premium are recurring monthly subscriptions unless a different billing interval is clearly displayed before purchase. By starting a paid subscription, you authorize the applicable recurring charge at the beginning of each billing period until the subscription is changed, paused, or canceled.
You may manage an eligible subscription through the billing portal made available from the owner dashboard. A cancellation generally takes effect at the end of the current paid billing period unless a different effective time is disclosed during the cancellation process. Plan access and account status may take time to update while Stripe or another payment provider processes the billing event.
Payment processing may be handled by third-party providers such as Stripe. We are not responsible for third-party payment platform errors, outages, charge failures, declined cards, bank issues, or third-party account restrictions.
5.2 Seasonal Pause
Seasonal Pause is a recurring $10.00 USD per month subscription option. It is a paid pause plan and is not the same as fully canceling service.
While Seasonal Pause is active, your CampBoard account and campground data are preserved, but the public guest guide displays a paused-service message instead of the normal published guide. The recurring Seasonal Pause charge continues each month until you switch to Basic or Premium or cancel the subscription.
You may reactivate directly from Seasonal Pause by switching to an available Basic or Premium subscription. A direct switch from Seasonal Pause is not treated as reactivation from fully canceled service and does not incur the canceled-service recovery fee described below.
5.3 Fully Canceled Service and Reactivation Recovery Fee
When service is fully canceled, the public guest guide may be unpublished or made unavailable. If you later reactivate fully canceled service, you must select a new Basic or Premium subscription and may be charged a one-time recovery fee in addition to the new recurring subscription charge.
The recovery fee is $10.00 USD for each started 30-day period beginning from the recorded effective date of the current cancellation period. The fee is limited to seven started periods and is therefore capped at $70.00 USD, even if service remains canceled longer.
The recovery fee is calculated when the reactivation Checkout session is prepared using the cancellation date recorded by The CampBoard. Stripe Checkout will display the recovery-fee quantity, recovery-fee total, selected subscription, and transaction total before payment.
The recovery fee is separate from the new Basic or Premium subscription charge. It is a one-time reactivation and account-recovery fee and is not payment for CampBoard service during the canceled period.
Service is not reactivated when payment is pending, incomplete, declined, failed, or abandoned. Reactivation occurs only after The CampBoard receives and validates a successful payment event from the payment provider.
If service is reactivated and later fully canceled again, the later cancellation begins a new cancellation period for purposes of any future recovery-fee calculation.
6. Guest Email Alerts and Communications
If you use guest email alert features, you are responsible for the content of messages and for complying with all laws and rules that apply to your communications with guests, including consent, unsubscribe, anti-spam, privacy, consumer protection, and recordkeeping obligations.
You must not use guest alert features for unlawful marketing, emergency-only alerts, deceptive messages, or messages to people who have not provided appropriate consent.
7. Analytics and Metrics
The CampBoard may provide aggregate usage analytics such as guest app views, QR code views, map views, email alert signup attempts, and successful email alert signups. Analytics are provided for convenience and may be delayed, incomplete, estimated, unavailable, reset, or affected by technical factors. Analytics are not guaranteed to be accurate and should not be treated as financial, legal, advertising, safety, or operational audit records.
8. No Professional Advice
The CampBoard does not provide legal, tax, accounting, insurance, safety, emergency management, cybersecurity, accessibility, medical, law enforcement, or regulatory advice. You are responsible for obtaining appropriate professional advice for your campground and operations.
9. Availability, Changes, and Support
We may update, modify, suspend, discontinue, restrict, or replace any part of The CampBoard at any time. We may perform maintenance, security updates, backups, migrations, or emergency changes. We do not guarantee uninterrupted, error-free, secure, or continuously available service.
Support availability, response times, and included support may vary by plan and by our then-current policies.
10. Third-Party Services
The CampBoard may rely on third-party services such as hosting providers, DNS providers, email providers, payment processors, analytics tools, security tools, and other vendors. We are not responsible for third-party outages, errors, data practices, delays, pricing changes, or service limitations.
11. Customer Data and Privacy
You are responsible for ensuring that you have the right to submit, process, store, and publish any data you provide to The CampBoard. You agree not to submit unnecessary sensitive personal information, protected health information, payment card data outside approved payment flows, government identifiers, or other high-risk information unless we have expressly agreed in writing and appropriate safeguards are in place.
We may store account, billing, security, operational, and legal acceptance records necessary to operate and protect The CampBoard, including records showing that an account owner accepted these Terms.
12. Intellectual Property
The CampBoard, including its software, designs, branding, templates, workflows, documentation, and platform features, is owned by The Computer Specialists, LLC or its licensors and is protected by applicable intellectual property laws.
You retain ownership of Customer Content you provide, subject to the rights you grant us to host, process, transmit, display, copy, back up, and otherwise use Customer Content as necessary to provide and protect The CampBoard.
13. Disclaimer of Warranties
To the maximum extent permitted by law, The CampBoard is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and reliability.
We do not warrant that The CampBoard will meet your requirements, prevent guest complaints, increase revenue, improve operations, ensure compliance, prevent emergencies, or operate without interruption, error, delay, data loss, or security incident.
14. Limitation of Liability
To the maximum extent permitted by law, The Computer Specialists, LLC and its owners, officers, employees, contractors, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost revenue; lost business; lost goodwill; lost data; business interruption; guest claims; safety incidents; property damage; personal injury claims arising from campground operations; or costs of substitute services, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to The CampBoard will not exceed the greater of: (a) the amounts you paid to us for The CampBoard during the three months before the event giving rise to the claim; or (b) one hundred dollars for free, trial, private invite, promotional, or comped accounts.
Some states do not allow certain exclusions or limitations. In those cases, the limitations apply to the fullest extent permitted by applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless The Computer Specialists, LLC and its owners, officers, employees, contractors, vendors, and affiliates from and against any claims, demands, damages, losses, liabilities, penalties, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your campground operations; Customer Content; your use or misuse of The CampBoard; guest claims; your violation of these Terms; your violation of law; your violation of third-party rights; your communications with guests; your maps, directions, rules, announcements, events, emergency contacts, or safety information; or any dispute between you and your guests, staff, vendors, owners, managers, or regulators.
16. Suspension and Termination
We may suspend, restrict, or terminate access to The CampBoard if we believe your use violates these Terms, creates risk, harms the platform, harms other users, creates legal exposure, creates security concerns, causes payment issues, or is otherwise inappropriate.
17. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except to the extent mandatory law provides otherwise. Subject to any non-waivable rights under applicable law, the state and federal courts located in Massachusetts will have exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or The CampBoard.
18. Non-Waivable Rights
Nothing in these Terms is intended to waive rights, duties, warranties, remedies, claims, or liabilities that cannot be waived under applicable law. Any limitation, disclaimer, exclusion, or indemnity in these Terms applies only to the maximum extent permitted by law.
19. Changes to Terms
We may update these Terms from time to time. The version and effective date will identify the applicable Terms. Continued use of The CampBoard after updated Terms are made available or presented for acceptance constitutes agreement to the updated Terms where permitted by law. We may require renewed acceptance for material changes.
